ABSTRACT
This talk provides an introduction to Aristotle’s thought on law (nomos) by considering two questions. First, to what extent are Aristotle’s statements on the rationality of law consonant with contemporary philosophical work (e.g. Raz, Finnis) emphasising the status of law as an achievement of practical reason? Second, what are the similarities and differences, at the normative level, between Aristotle’s constitutional theory and the theoretical foundations of modern, or post 1789, constitutions? I will argue that although Aristotle’s thought on law resists easy assimilation to modern theories and assumptions, it nonetheless remains of abiding significance for understanding the role of law in promoting ordered human relations.

摘要
本讲座通过考察两个问题,介绍亚里士多德关于“法”(nomos)的思想。首先,在何种程度上,亚里士多德关于法律理性的论断,符合当代哲学著作(如拉兹,菲尼斯)所强调的,法律的地位是实践理性的成就?第二,在规范的意义上,亚里士多德的宪法理论与现代(或者说1789年之后)宪法理论的基础有何异同?本讲座论证,尽管亚里士多德的法律思想很难被现代理论及假设所吸收,然而,对于理解法律如何促进有序的人类关系而言,它依旧意义深远。
