Abstract: This article examines influential accounts of the basis for Indigenous rights, considers their strengths and weaknesses, and ascertains whether and in what degree they support effective self-government and self-determination for Indigenous peoples. More specifically, it examines, firstly, the culturalist argument for minority rights developed by Will Kymlicka, and secondly James Tully’s historical approach that draws on the tradition of treaty relations in North American colonialism. Finally, it outlines a third approach based on the political liberalism of John Rawls. I argue that the conditions of legitimate government set out by Rawls are a better way to provide normative foundations for Indigenous rights in contemporary postcolonial democracies.

摘要:本文探讨有关土著权利之基础的有影响力的解释,考量它们的优缺点,并探明它们是否支持以及在何种程度上支持土著族群的有效自治与自决。确切地说:首先探讨由威尔·金立卡发展的少数群体权利的文化主义论述;其次,考察詹姆斯·塔利的历史学路径;最后,概述基于罗尔斯政治自由主义的第三条路径。本文认为,罗尔斯提出的合法政府诸条件,可以更好地为当代后殖民民主国家中的土著权利提供规范性基础。
