ABSTRACT

This chapter examines the ideas of the brothers Hozumi Nobushige (1855-1926) and Hozumi Yatsuka (1860-1912), two legal scholars who had a significant influence on modern Japanese legislation, depicting the intellectual process by which the contradiction between family sentiment and the modernist principles of evolutionism and nationalism was gradually revealed, albeit intentionally concealed. In his essay titled “Revenge and Law,” Hozumi Nobushige acknowledged that “social psychological satisfaction” (“social conscience” or “social emotion”) did not necessarily follow the principle of “public authority replacing private enforcement,” which indicated the evolution of law. He argued that this was the reason why “revenge killings” were legally accepted in Japan until the 1870s. On the other hand, Hozumi Yatsuka contended that the state itself was a “blood group,” which required obligatory commitments such as protection, duty, and solidarity for its maintenance; however, love for one's family was not particularly significant. Through these considerations, I aim to clarify that while ‘family emotions’ were excluded from the institutional design of Japan's modern legal system, they remained in a contradictory state. This represents one aspect of the ideology of the modern imperial regime.

摘要

本章节考察了穗积陈重(1855-1926)与穗积八束(1860-1912)兄弟的思想,这两位法学学者对现代日本立法有着重要的影响。本章旨在揭示家庭情感与进化论、民族主义等现代原则之间的矛盾——这一矛盾虽被有意掩盖,却仍在他们的思想发展过程中逐渐显现。在题为《复仇与法律》的文章中,穗积陈重承认,“社会心理满足”(“社会良知”或“社会情感”)未必遵循“公共权威取代私人执行” 这一标志法律演进的原则。他认为,这正是日本直到19世纪70年代仍在法律上接受“复仇性杀人”的原因。另一方面,穗积八束则主张,国家本身就是一个“血缘团体”,其存续需要诸如保护、义务和团结等强制性承诺;然而,对家庭的爱在其中却并不具有特别重要的意义。通过这些考察,我意在澄清,虽然“家庭情感”被排除在了日本法律体系的制度设计之外,却仍始终处于矛盾的状态之中。这正反映出现代帝制意识形态的其中一个面向。
